Eligibility Requirements for a Sibling Visa / F4 Visa

  1. U.S. Citizenship: The first requirement is that as the petitioner, you must be a U.S citizen. It is important to understand that being a lawful permanent resident does not allow one to petition for one’s siblings to join them in the United States.
  2. Age Requirement: It is important for you as the petitioner and your sibling to satisfy some age criteria. The petitioner must be at least 21 years of age and the sibling must be unmarried and under the age of 21 years when the petition is filed.
  3. Proof of Relationship: To prove that you have a relationship with your sibling, it is crucial to present some evidence on this. These may include birth certificates, adoption papers or any other legal documents that prove your relationship with such a person.
  4. Financial Support: The petitioner has to show that he or she can provide for his or her sibling once the latter arrives in the United States as an immigrant. This process often requires you to complete an Affidavit of Support (Form I-864) wherein you promise to support your sibling financially.
  5. Intent to Reside in the U.S.: Both you, as the petitioner, and your sibling must demonstrate a genuine intention to reside permanently in the United States

The Application Process

Embarking on the journey towards obtaining a sibling visa involves several sequential steps, including:


Filing the Petition

As the U.S. citizen petitioner, you must initiate the process by filing Form I-130, Petition for Alien Relative, with U.S. Citizenship and Immigration Services (USCIS). This form serves as the declaration to sponsor your sibling for immigration.

Waiting for Approval

Following the submission of your petition, USCIS will review it to ensure compliance with all criteria. Upon approval, the petition will be forwarded to the National Visa Center (NVC) for further processing.

Visa Availability

It's essential to understand that sibling visas are subject to numerical limitations, as they fall under the Family Fourth Preference category. Consequently, there may be a considerable wait time for visa availability, contingent upon factors such as your sibling's country of origin and the prevailing visa bulletin.

Completing Visa Application

Upon the availability of a visa, your sibling will be duly notified by the NVC to complete the requisite forms and undergo a comprehensive medical examination. Additionally, they will be required to attend an interview at the U.S. embassy or consulate in their country of residence.

Immigration to the U.S.

Upon the successful completion of the visa application process, including the requisite medical examinations and background checks, your sibling will be granted an immigrant visa, enabling them to travel to the United States. Upon arrival, they will attain lawful permanent residency status (green card status)!
