EB1-A Eligibility Requirements

1. EB1-A: Individuals with Extraordinary Ability

  • Eligibility Criteria:
    • Our EB1 Attorney will go through all the eligibility criteria with you, listed below, during your initial consultation.
    • You must demonstrate sustained national or international acclaim in your field of expertise, whether it be in the sciences, arts, education, business, or athletics.
    • You must provide evidence of your extraordinary ability through one-time achievements like a major internationally recognized award (e.g., a Nobel Prize) or at least three of the following criteria:
      • Documentation of lesser nationally or internationally recognized prizes or awards.
      • Membership in associations that require outstanding achievements.
      • Published material about you in professional or major trade publications.
      • Evidence of participation as a judge of the work of others in the field.
      • Evidence of original contributions of major significance to the field.
      • Authorship of scholarly articles in professional journals.
      • Display of your work at artistic exhibitions or showcases.
      • Evidence of a leading or critical role in distinguished organizations.
      • Evidence that you command a high salary or other significantly high remuneration.
      • Commercial successes in the performing arts.
  • Self-Petition Option: Unlike other employment-based visas, you do not need a job offer or employer sponsorship to apply for an EB1-A visa.

EB1-B Eligibility Requirements

2. EB1-B: Outstanding Professors and Researchers

  • Eligibility Criteria:

EB1-C Eligibility Requirements

3. EB1-C: Multinational Executives and Managers

  • Eligibility Criteria:
    • You must have been employed outside the United States in a managerial or executive capacity for at least one year within the three years preceding the filing of your petition or your most recent lawful admission if you are already in the U.S.
    • Your employer must be a U.S. employer and must have been doing business for at least one year as an affiliate, subsidiary, or branch of the foreign company.
    • You must be entering the U.S. to work in an executive or managerial capacity with the same employer or a related entity.
